Please read these terms carefully before using the PropTeam.in App. These Terms and Conditions are a legal document. It sets out our agreement with you and forms the basis of your rights and obligations to us.
1. General Provisions
The use of PropTeam.in App and Associate Membership of the PropTeam.in network is subject to the following Terms and Conditions - which are effective from 15th May, 2020.
PropTeam.in App (the App) is owned by Mr. Shashank Bansal whose registered office is situated at Pancholi Complex, Opp. Indian Oil Petrol Pump, Near Gulmohar Garden, Vatika, Tonk Road, Jaipur, Rajasthan India Pin-303905 (referred to as “we” or us” below).
An Associate Member of the PropTeam.in will be entitled to further introduce new Associate Members and so on.
All the Associate Member introduced by you or further introduced by your Associate Members and so on, along with you will be known as your team.
You can make the distribution chain of fellow associate member under your down the line in your distribution chain.
If you become a Associate Member of the PropTeam.in network, you will be entitled to receive a reward for each completed sale made by you or your team. The value of the reward is available with us and same will be presented as and when requested (this reward value will be in total and same will be distributed among you and all Associate Member in your team as per their slab).
The concept behind our idea is network and referral marketing. As our associate member, you will earn from two potential revenue streams, The first is paid out on the sales made directly to your own reference retail customers. The second is paid out on the sales made to the reference of down line associate member in your distribution chain.
You can help us to sell products directly to end-user retail consumers by means of relationship referrals and word of mouth marketing.
Most importantly as you make the distribution chain of fellow associate member, so you will get the slab difference amount on the sales made to the reference of down line associate member in your distribution chain.
1.1 Jurisdiction
These terms and conditions apply as between you, the user of the APP, or Associate Member and us, PropTeam.in.
By entering our App, or becoming a Associate Member, you are accepting these Terms and Conditions. If you do not agree to be bound by these Terms and Conditions, you should stop using the App immediately. By making an application for Membership you agree to these Terms and Conditions and confirm that you understand your obligations to us.
Your use of the App and your Associate Membership of the PropTeam.in network is governed by the laws and any dispute arising in connection with these Terms and Conditions, your use of the App, or any of our Services shall be heard exclusively in the courts of Jaipur.
Nothing in these Terms and Conditions shall be construed to create a joint venture, partnership or agency relationship between you and us, and neither of us shall have the right or authority to incur any liability debt or cost or enter into any contracts or other arrangements in the name of or on behalf of the other.
These Terms and Conditions will only apply as between us and you. Unless as otherwise stated in these Terms and Conditions no other person may benefit or rely upon these Terms and Conditions.
1.2 Language
These Terms and Conditions and our correspondence with you will be communicated in the English language.
1.3 Enforceability
We may modify any of these Terms and Conditions, at any time. Any revision will be posted on the App, on this page.
If any provision of these Terms and Conditions shall be invalid or unenforceable, it shall not affect any other provision, which shall remain in full force and effect.
These Terms and Conditions and the Privacy Policy form the entire agreement between us and your Associate Membership excludes all other documents, statement or discussions with you which may have taken place prior to your application for Associate Membership being accepted.
1.4 Transfer of Rights
We may transfer our rights and obligations under these Terms and Conditions to another organisation without notice, but this will not affect your rights or our obligations to you.
If any event occurs that prevents us from carrying out our obligations or displaying the App we will take reasonable steps to reduce the effect this has on you and your reference amount under the PropTeam.in network. If despite our efforts this disabling event continues for any period exceeding one week we may terminate your Membership but as a consequence will incur no liability to you.
2. Definitions & Interpretations
In these Terms and Conditions, the following words shall have the following meanings:
Content
means any text, graphics, images, audio, video or other forms of information that appears on or forms part of the App, and are capable of being stored on a computer/ mobile or any electronic device.
Associate Members
means users of the App who have chosen to register with the PropTeam.in network. This definition also relates to “Associate Membership” being the relationship between us and Associate Members.
Customer
means a person who referred by an Assiciate Member and purchases a product.
Services
means the services provided by PropTeam.in to Associate Members under these Terms and Conditions.
System
means any online communications infrastructure that PropTeam.in makes available through the App. This includes, but is not limited to, emails, message boards and software applications.
App
means the App that you are currently using and any module of this App (unless expressly excluded by their own terms and conditions).
PropTeam.in
refers to the name of the App.
Persons
words denoting persons include natural persons, partnerships, limited liability partnerships, bodies corporate and unincorporated associations of persons.
Headings, titles, sub-headings
such as (\'Definitions and Interpretations\' at the start of this section) are purely for ease of reference and do not form part of or affect the interpretation of these Terms and Conditions.
Include & Including
references to these words shall be deemed to mean respectively \'include(s) without limitation\' and \'including without limitation\'.
You & your
The person who proposes to use or is using this App.
3. Intellectual Property
All Content included on the App, unless stated, is the property of PropTeam.in and our affiliates. By continuing to use the App, you acknowledge that such material is protected by the laws.
Users may view App pages on screen and may print or download extracts for personal use only. Users may supply a copy of any such extract to any third party provided that:
1. The extract is for their and that third party’s own personal use
2. The extract is not supplied as part of or incorporated in another work, App, website or publication
3. The extract is not supplied either directly or indirectly in return for commercial gain
4. The third party is made aware that the source of the Content is the App and that these Terms and Conditions apply equally to them, as to you.
No part of the App may be reproduced, transmitted to, or stored on any other website/ App or in any other form of electronic medium without PropTeam.in’s express written consent.
4. App usage
You agree to indemnify PropTeam.in against any loss, liability, claim, demand, damage or expense (including legal fees) that may occur in connection with your use of the App.
We make all reasonable effort to test Content material before placing it on our App. In the very unlikely event of any loss, disruption, or damage, to data or your computer/ mobile system, we cannot be held responsible.
4.1 Availability of the Web site
While we take all reasonable steps to ensure the App is always accessible, we cannot be held liable if, for any reason, it is unavailable. The Service is provided “as is” and on an “as available” basis. We give no warranty that the Service will be free of defects and/or faults.
PropTeam.in accepts no liability for any disruption or non-availability of the App resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.
We may have to suspend access to the App for routine or emergency updates and maintenance, but we\'ll try to keep any disruption to a minimum.
4.2 Your Obligations
Without limitation, you undertake and accept not to use or permit anyone else to use the App or Service in the following circumstances:
1. To send or receive any material which is not civil or tasteful;
2. To send or receive any material which is threatening, grossly offensive, of an indecent, obscene or menacing character, blasphemous or defamatory of any person, in contempt of court or in breach of confidence, copyright, rights of personality, publicity or privacy or any other third party rights;
3. To send or receive any material for which you have not obtained all necessary licenses and/or approvals (from us or third parties); or which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party in any Country in the World;
4. To send or receive any material which is technically harmful (including computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data);
5. To cause annoyance, inconvenience or needless anxiety;
6. To intercept or attempt to intercept any communications transmitted by way of a telecommunications system;
7. For a purpose other than for which we have designed them, or intended them to be used;
8. For any fraudulent purpose; or in any way which is calculated to incite hatred against any ethnic, religious or any other minority or is otherwise calculated to adversely affect any individual, group or entity.
The following uses of the App are expressly prohibited and you undertake not to do (or to permit anyone else to do) any of the following:
1. Resell the Service or Site;
2. Furnish false data including false names, addresses and contact details and fraudulent use of credit/debit card numbers;
3. Attempt to circumvent our security or network including accessing data not intended for you, logging into a server or account you are not expressly authorised to access, or probe the security of other networks (such as running a port scan);
4. Access the App or Services in such a way as to, or commit any act that would or does, impose an unreasonable or disproportionately large load on our infrastructure;
5. Execute any form of network monitoring which will intercept data not intended for you;
6. Send unsolicited mail messages, including the sending of \'junk mail\' or other advertising material to individuals who did not specifically request such material. You are explicitly prohibited from sending unsolicited bulk mail messages. This includes bulk mailing of commercial advertising, promotional, or informational announcements, and political or religious tracts. Such material may only be sent to those who have explicitly requested it. If a recipient asks to stop receiving email of this nature, you may not send that person any further email;
7. Create or forward \'chain letters\' or other \'pyramid schemes\' of any type, whether or not the recipient wishes to receive such mailings;
8. Send malicious email, including flooding a user or site with very large or numerous emails;
9. Enter into fraudulent interactions or transactions with us or a Customer or a Associate Member of PropTeam.in;
10. Use in an unauthorised manner, or forge, mail header information;
11. Engage in any unlawful activity in connection with the use of the App and/or the Services or any Campaign.
4.3 Content
We reserve the right to add, amend, delete, edit, remove or modify any information, Content material or data displayed on the Web Site, without notice from time to time.
4.4 Links to External Sites
This App may contain links to other websites. Unless stated, PropTeam.in has no control over or proprietary interest in any of these websites and, as such, makes no promises nor gives and warranties with regard to the quality, security, accuracy or any other aspect of such websites, and excludes any and all liability arising from your use of the same.
4.5 Privacy
Our Privacy Policy (which forms part of these Terms and Conditions) outlines how your Associate Membership account information is handled. It includes the methods we employ to ensure privacy. By using the App, you agree to the way in which we process and deal with the personal information you give to us, as a Associate Member.
We may disclose your personal information or access your account if required to do so by law, any court order or any other applicable regulatory, compliance, Governmental or law enforcement agency.
4.6 Disclaimers
1. PropTeam.in makes no warranty or representation that the App will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all computer systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from your use of our Services.
2. This App is not intended to provide advice, and the Content of the App should not be relied upon when making any final decisions.
5. Complaints
5.1 Our Services
Our aim is at all times to provide you with an excellent service. If you are unhappy with our Services for any reason, please write to us at info@propteam.in.
Please include your name and address, a contact telephone number, your Associate Membership details and details of why you are unhappy. This will help us to respond to you as quickly as possible. If we do not have enough information to investigate your complaint we will try and contact you to ask for further details.
5.2 Third-party Services
If you are unhappy with any product you have obtained from a Builder/ Developer, you should address your complaint directly to the Builder/ Developer. If you require their contact details, please contact us info@propteam.in and we will be happy to assist.
We cannot answer complaints about products or services on behalf of a Builder/ Developer or accept responsibility for any such complaints.
5.3 Liability
Your attention is drawn to this section
We will display all details with reasonable care and skill but we cannot and do not guarantee the details made by Builder/ Developer. As we do not sell any goods or services directly to you, or anyone else and all rewards under the PropTeam.in network are governed by these Terms and Conditions this sum is deemed reasonable in the circumstances.
Whilst nothing in these Terms and Conditions seeks to exclude or limit our liability for death or personal injury resulting from our negligence, or for any damage or liability incurred by you as a result of any fraud or fraudulent misrepresentation on our part, we are unable to cover any losses which are not directly covered by these Terms and Conditions (for example loss of earnings, loss of commissions, loss of opportunity or profit) due to any loss or delay in the receipt of a share or an incomplete purchase by a Customer.
Any issues related to any purchase must be sent directly to the Builder/ Developer in question. We are acting solely as an intermediary between you and the Builder/ Developer and cannot accept any liability for:
1. Any loss of revenue, business, anticipated savings or profits;
2. Any indirect claims or other claims arising through non-supply or late supply of any commission, a failure to credit your bank account speedily or other non-performance of our obligations to you;
3. Any termination or cancellation of a Purchase instigated by the Builder/ Developer;
4. The termination of your Membership (for any or no reason);
5. Any failure by you to comply with these Terms and Conditions or any conditions imposed on the campaign by the Builder/ Developer.
We are not responsible for any losses you incur as a result of your use of the Smartphone App which can be downloaded from the Web.
You, (the “User”) can access PropTeam.in App (“App”), subject to the terms and conditions of use, as changed / updated from time to time entirely at the discretion of PropTeam.in (“We/ PropTeam.in”) as set out below (“Terms of Use / User Terms of Use”). This Agreement is for an indefinite term and you understand and agree that you are bound by such terms.
1. The App is owned, managed and operated by PropTeam.in.
2. You must be 18 years of age or older to visit or use the App in any manner. In the event that you are below 18 yrs. of age, you are visiting the App at your own risk and you alone shall be liable for your actions. By visiting this App or accepting these Terms of Use, you represent and warrant to us that you are 18 years of age or older, and that you have the right, authority and capacity to use the App and agree to and abide by these Terms of Use. You also represent and warrant to us that you will use the App in a manner consistent with any and all applicable laws and regulations.
3. By using the App, you agree to follow and be bound by all terms and conditions concerning your use of the App. Certain areas of the App may have different terms of use posted. If there is a conflict between the Terms of Use and terms of use posted for a specific area of the App, the latter shall have precedence with respect to your use of that area of the App.
4. PropTeam.in may terminate User’s access to the App or any part thereof at any time and for any reason without any notice. The provisions regarding disclaimer of warranty, accuracy of information, software, database other system or functionality of App and indemnification shall survive such termination. PropTeam.in may monitor User’s access to the App.
5. PropTeam.in may change or discontinue any aspect of the App at any time, including, its content or features. PropTeam.in reserves the right to change the Terms of Use applicable to use of the App. Such changes shall be effective immediately upon notice, which shall be placed on the App.
6. All contents on the App are the exclusive property of PropTeam.in except the third party content. The software, text, images, graphics, video and audio used on the App belong to or are licensed to PropTeam.in or its subsidiaries and affiliates. No material from the App may be copied, modified, reproduced, republished, uploaded, transmitted, posted or distributed in any form without prior written permission from PropTeam.in. All rights not expressly granted herein are reserved. Unauthorised use of the materials appearing on the App may violate copyright, trademark and other applicable laws, and could result in criminal or civil penalties. You are granted a non-exclusive, non-transferable, limited right to access the App and avail the services provided by PropTeam.in on the App.
7. PropTeam.in does not make any warranties, express or implied, with respect to any service, information, data, software, system, functionality, statements or products made available on the App. The information contained in the App has been obtained from sources believed to be reliable. The App, and all content, materials, information, software and services provided on the App, are provided on an “as is” and “as available” basis.
8. PropTeam.in does not warrant that the App will operate error-free or that the App and its servers are free of computer viruses or other harmful mechanisms. If your use of the App or content therein results in the need for servicing or replacing equipment or data, PropTeam.in is not responsible for any such costs. App and content are provided on an “as is” basis without any warranties of any kind. PropTeam.in to the fullest extent permitted by law, disclaims all warranties, whether express or implied, including the fitness for particular purpose and non-infringement. PropTeam.in makes no warranties about the accuracy, reliability, completeness, or timeliness of the content, services, software, text, graphics, and links.
9. PropTeam.in shall not be liable for any damage to User’s computer system/ mobile/ any electronic device or loss of data that result from the download of any content, materials, and information from the App or use of any software, systems, functionality, or other services on the App. Under no circumstances will PropTeam.in be liable in any way for any content, including, but not limited to, inaccurate, false, incomplete, threatening, defamatory, obscene, offensive, illegal content, infringement of other’s rights including intellectual property rights, for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any content posted or uploaded. Further, under no circumstances, PropTeam.in shall be liable for any unlawful act of the User or its affiliates, relatives, employees, agents including misuse of any data, unfair trade practices, fraud, cyber squatting, hacking and other cyber crimes. In no event shall PropTeam.in be liable for damages of any kind, including without limitation, direct, incidental or consequential damages (including, but not limited to, damages for lost profits, business interruption and loss of programs or information) arising out of the use of or inability to use App, or any information provided thereon, or any claim attributable to errors, omissions or other inaccuracies in the App.
10. You may not send, submit, post, or otherwise transmit, material or messages that contain software virus, or any other files that are designed to interrupt, destroy, and negatively affect in any manner whatsoever, any electronic equipment in connection with the use of the App, or other user’s ability to use the App.
11. User agrees to indemnify and hold PropTeam.in, its subsidiaries, affiliates, officers and employees, harmless from any claim, demand or damage, including reasonable attorney’s fees, asserted by any third party due to or arising out of your use of or conduct on the App PropTeam.in reserves the right to disclosure any personal information about you and your use of the App including its contents, without your prior permission if PropTeam.in has a good faith belief that such action is necessary to :
* confirm to legal requirements or comply with legal process;
+ protect and defend the rights or property of PropTeam.in or its affiliated companies;
+ enforce the Terms of Use; or
+ act to protect the interest of its members or others.
12. The User’s right to privacy is of paramount importance to PropTeam.in. Any information provided by the User will not be shared with any third party, except in the manner provided under these Terms of Use and for the intended purpose for which such information is provided by the User, in which case User’s consent is implied. PropTeam.in reserves the right to use the information to provide the User a more personalized online experience.
13. If the App provides links to website and access to content, products and services from third parties, including users, advertisers, affiliates and sponsors of the App, you agree that PropTeam.in is not responsible for the availability of, and content provided on, third party website or content. The User is requested to peruse the policies posted by other website regarding privacy and other topics before use. PropTeam.in is not responsible for third party content accessible through the App, including opinions, advice, statements and advertisements, and User shall bear all risks associated with the use of such content. PropTeam.in is not responsible for any loss or damage of any sort which User may incur from dealing with any third party.
14. By using any third party content, User may leave the App and be directed to an external website, or to a website maintained by an entity other than PropTeam.in. If you decide to visit any such website, you do so at your own risk and it is your responsibility to take all protective measures to guard against viruses or any other destructive elements. PropTeam.in makes no warranty or representation regarding, and does not endorse, any linked website/ App or the information appearing thereon or any of the products or services described thereon. Links do not imply that PropTeam.in or the App sponsors, endorses, is affiliated or associated with, or is legally authorized to use any trademark, trade name, logo or copyright symbol displayed in or accessible through the links, or that any linked App is authorized to use any trademark, trade name, logo or copyright symbol of PropTeam.in or any of its affiliates or subsidiaries. You hereby expressly acknowledge and agree that the linked Apps are not under the control of PropTeam.in and PropTeam.in is not responsible for the contents of any linked website/ App or any link contained in a linked website/ App, or any changes or updates to such Apps. PropTeam.in is not responsible for webcasting or any other form of transmission received from any linked website/ App. PropTeam.in is providing these links to you only as a convenience, and the inclusion of any link shall not be construed to imply endorsement by PropTeam.in in any manner of the website.
15. For availing the services under the App, registration by the User is required. You will receive a OTP/ password and account designation upon completing the registration on the App. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. By registering, you agree to the following terms in addition to any other specific terms which shall be posted at an appropriate location of the App. Each registration is for a single individual user only. To access these services, you will be asked to enter your individual User Name and OTP/ Password. Therefore, we do not permit any of the following:
* Any other person sharing your User Name and Password.
* Any part of the App being cached in proxy servers and accessed by individuals who have not registered with App as users.
* Access through a single User Name and Password being made available to multiple users on a network.
16. If we reasonably believe that a User Name and Password are being used / misused in any manner as clarified above, we reserve the right to cancel access rights immediately without notice, and block access to all users from that IP address.
17. You specifically agree that PropTeam.in shall not be responsible for unauthorized access to or alteration of your transmissions or data, any material or data sent or received or not sent or received through the App.
18. Specific Prohibited Uses:
The job posting and resume database features of the App may be used only for lawful purposes by individuals seeking employment and career information and employers seeking employees. PropTeam.in specifically prohibits any other use of the App, and all Users agree not to do any of the following:
* Use any App Resume Database for any purpose other than as an employer seeking employees, including but not limited to using the information in the Resume Database to refer, sell or promote any products or services;
* Post or submit to the App any incomplete, false or inaccurate biographical information or information which is not your own;
* Send unsolicited mail or e-mail, making unsolicited phone calls or send unsolicited faxes regarding promotions and/or advertising of products or services to a user of the App;
* Delete or revise any material posted by any other person or entity;
* Take any action that imposes an unreasonable or disproportionately large load on the App’s infrastructure;
* Attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the App;
* Aggregate, copy or duplicate in any manner any of the content or information available from the App; or
* The Users agree not to use / insert any of the User’s URL, web link, e mail address and website while posting any job on the App.
On non conformance by users of any of the aforesaid terms, may in its sole discretion, restrict or terminate the offending User’s ability to access the App and determine whether to take any other actions whether to remove or request the removal of the User’s content. PropTeam.in shall have no liability or responsibility whatsoever to Users for performance or non performance of such activities.
19. PropTeam.in reserves the right in its sole discretion to investigate and take legal action against anyone who engages in any illegal or prohibited conduct or otherwise violates these Terms of Use, including without limitation, removing the User content from the App and/or terminating the offending User’s ability to access the App and/or use services therein. PropTeam.in may take any other action with respect to User content or User actions that it deems necessary or appropriate in its sole discretion if it believes it may create liability for PropTeam.in or may cause PropTeam.in to lose (in whole or in part) the services of its ISPs or other suppliers.
20. The User hereby specifically agrees to comply with the requirements of the any Information Technology Act as also rules, regulations, guidelines, bye laws and notifications made there under, while on the App. The user also undertakes that the content provided by him/her is not defamatory, obscene, threatening, abusive or hateful. The User shall alone be responsible for all his acts, deeds and things and that he alone shall be liable for civil and criminal liability there under or under any other law for the time being in force.
21. PropTeam.in may, if you so choose send direct mailers to you at the address given by you. You have the option to ‘opt-out’ of this direct mailer by way of links provided at the bottom of each mailer. PropTeam.in respects your privacy and in the event that you choose to not receive such mailers, PropTeam.in will take all steps to remove you from the list.
22. PropTeam.in recognizes the receipt, transmission or distribution of spam emails (unsolicited bulk emails) as a major concern and has taken reasonable measures to minimize the transmission and effect of spam emails in its computing environment. All emails received by PropTeam.in, are subject to spam check. Any email identified as spam will be rejected with sufficient information to the Sender for taking necessary action. With this measure, along with other technical spam reduction measures, PropTeam.in hopes to minimize the effect of spam emails. PropTeam.in reserves the right to reject and/or report any suspicious spam emails, to the authorities concerned, for necessary action, from time to time.
23. No failure or delay by PropTeam.in in exercising any right, power or privilege under the Terms of Use will operate as a waiver of it, nor will any single or partial exercise of it preclude any further exercise or the exercise of any right, power or privilege under the Terms of Use.
24. The App is controlled, operated and administered by PropTeam.in from its offices within India. PropTeam.in makes no representation that Materials on this App are appropriate or available for use at any other location(s) outside India. Any access to this App from territories where their contents are illegal is prohibited. You may not use the App or export the materials in violation of any applicable export laws and regulations. If you access this App from a location outside India, you are responsible for compliance with all local laws.
25. The Terms of Use shall be governed by the Laws of India. The Courts of law at Jaipur shall have exclusive jurisdiction over any disputes arising under the Terms of Use.

* Additional information: all information supplied regarding Customer is not used by PropTeam.in for any purpose other than for logging and management.
* Log information: is used for management and analytics, to position specific Campaigns to individual Members.
We may also use your data, or permit selected third parties to use your data, to provide you with information about products that may be of interest to you. We or they may contact you about these by post or telephone.
If you are an existing customer, We will only contact you by electronic means (e-mail or SMS) with information about products similar to those that were the subject of a previous suggest/ reffered to you.
If you are a new customer, and where We permit selected third parties to use your data, We (or they) will contact you by electronic means only if you have consented to this.

This instrument here after referred to as the agreement executed between applicant and PropTeam.in. PropTeam.in is engaged in the business of real estate through network and referral marketing. The PropTeam.in authorises Associate Members across the country for giving reference and to sale of its Products, who have valid RERA agent certificate of the respective state.
In case one person join PropTeam.in and become Associate Member but does not have the RERA agent certificate, then he must apply for the same as soon as possible. Reference amount/ commission will be paid to him only after getting RERA agent certificate.
An individual (Indian Citizen only) intended to become Associate Member can apply for the same in prescribed application form of the PropTeam.in. There is no fee or charge for becoming Associate Member of the PropTeam.in. The applicant must be 18 years of age or above. The PropTeam.in exclusively uses its website/ App to display the details of the products, marketing methods and business monitoring. It also uses verbal publicity to promote its business. For smooth running, simplifying, keeping transparent, prevention of fraudulent practices and betterment of the business, the PropTeam.in has framed certain rules and regulations, marketing plan, terms and conditions etc. WHEREAS the applicant has gone through the PropTeam.in's official website/ App and read printed documents, brochures including stipulated terms and conditions for becoming Associate Member.
The PropTeam.in and Associate Member have clearly understood and agreed to abide by the terms and conditions as laid down herein at the time of agreement.
Now this agreement of associate member witnesses as follows:
Definitions:
The following words used in these presents shall have the meaning as defined hereunder:
Selling:
means marketing, distribution and sale of products.
Associate Member:
means a person authorised, directly or indirectly, by a Associate Member through a legally enforceable written contract.
Consumer:
means a person who purchases real estate product.
Products:
means any real estate product i.e. plot, flat, villa, house, land, shop, office etc.
Password:
means unique password awarded to each Associate Member to allow him to log on to the App of the PropTeam.in.
Website/ App:
means the official website/ App of PropTeam.in.
The authorisation of associate member and understanding:
* After submitting application form to the PropTeam.in duly signed by applicant, the PropTeam.in upon scrutiny and verification of the details submitted by applicant in application form may register as "Associate Member" and authorise him for reference/ selling of the products of the PropTeam.in. PropTeam.in exclusive reserves the right to accept or reject or decline the application at its discretion without assigning any reason whatsoever.
* Instead of giving reference, If an Associate Member want to sell the product of PropTeam.in then he must have valid RERA agent certificate of the respective state. Commission will be released on the sell will be released only when the valid RERA agent certificate is submitted to the PropTeam.in.
* All the taxes as per law on the reference amount/ commission will be borne by the Associate Member.
* All the requirement of RERA must be fulfilled by the Associate Member, in case he is selling the product.
* The Associate Member shall enjoy the following privileges:
+ Reference amount on the effecting sale of products of the PropTeam.in as per marketing plan.
+ No territorial restriction to refer the products.
+ Search and inspect his/her account on website/ App of the PropTeam.in through I.D. and password awarded by the PropTeam.in.
+ Reference amount/ commission of the Associate Member and his down line associate member in his distribution chain shall be as per slab either by his personal efforts or through team as stipulated in the marketing plan of the PropTeam.in.
+ An individual, upon appending his/her signature at the bottom of this application form shall be deemed to have accepted the terms and conditions stipulated herein. Upon registration after scrutiny of the details submitted by applicant in application form, he shall become the Associate Member of the PropTeam.in. Allotment of password and ID shall be construed as registration as Associate Member.
+ The applicant hereby covenants that as under:
# That he has clearly understood the marketing methods/plan, the compensation plan, its limitations and conditions. He/She agrees that he/she is not relying upon any misrepresentation or fraudulent inducement or assurance that is not set out in terms and conditions or other officially printed or published materials of the PropTeam.in.
# Relation between the PropTeam.in and the Associate Member shall be governed, in addition to this agreement, by the rules and procedure mentioned in the marketing plan available on website/ App. The Associate Member further confirms that he/she has read and understood guidelines and terms & conditions carefully and agrees to be bound by them.
# Associate Member shall act as freelancer. He shall not commit any misfeasance or malfeasance to create any liability/obligation on the PropTeam.in of whatsoever nature.
# Associate Member shall be responsible for paying all taxes whether direct or indirect including but not limited to income tax, GST and other taxes chargeable to Associate Member on amount earned hereunder. All legal, statutory, financial and other obligations associated with Associate Member's business shall be the sole responsibility of Associate Member.
# It is made and understood in very clear terms that Associate Member is not an agent, employee, an authorised representative of the PropTeam.in or its service provider and shall not be entitled to any employee's benefits. He/She is not authorised to receive/accept any amount/payment for and on behalf of the PropTeam.in. Any payment/amount received by him/her will not be deemed to be received by the PropTeam.in and the PropTeam.in shall take necessary action against such Associate Member.
# Associate Member shall keep proper book of account stating the details of the sale of products, price, tax, quantity etc.
# Associate Member hereby declare that all the information furnished by him to the PropTeam.in are true and correct to his/her best of knowledge and nothing is concealed. PropTeam.in reserves the right to take any action against the Associate Member in the event of it is discovered that the Associate Member furnished any wrong/false information to the PropTeam.in.
1. The PropTeam.in may appoint any person for collection of documents or payment. Associate Member is required to visit the PropTeam.in official website/ App from time to time to get such appointment and avail facilities, make payment, collect valid receipt.
2. Associate Member shall use his/her best efforts to promote the sale of products and maximize them. Associate Member shall also provide reasonable assistance to PropTeam.in in promotional activities as and when required/ requested.
3. The Associate Member will be eligible for remuneration as per slab of sale of products done by him/her and down line associate member in his/ her distribution chain subject to the eligibility of norms formulated by the PropTeam.in from time to time according to marketing plan and not in any other form/manner is payable/given.
4. Track ID has to be quoted by the Associate Member for all his/her transactions and correspondence with the PropTeam.in. The Track ID will be generated automatically by the server/ App.
5. No communication will be entertained without unique ID and password. Associate Member shall preserve the ID and password properly as it is "must" for logging on website/ App.
6. Reference amount/ commission to the shall be subject to statutory deductions under income tax and other acts as applicable for the time being in force.
7. The PropTeam.in reserves right to withheld/block/suspend I.D. of the Associate Member in the event of the Associate Member fails to provide any detail as desired by the PropTeam.in from time to time.
8. Associate Member undertakes to adhere to policies, procedures, guidelines and rules & regulations formed by the PropTeam.in.
9. The Associate Member shall be faithful to the PropTeam.in and uphold the integrity and decorum of the PropTeam.in and shall maintain good relations to other Associate Member and his/her clients.
10. PropTeam.in reserves the right to modify the terms and conditions, Products, Marketing Plan, Business and other policies at any time without any prior notice. Modification shall be published through the official website/ App of the PropTeam.in or any other mode as PropTeam.in may deem fit and proper and such modification/ alteration and amendments made by the Government from time to time, shall be applicable and binding upon the Associate Member from the date of such modification/alteration.
11. If any Associate Member loses his contractual capacity due to any reason or in case of death of Associate Member either his nominee or one of the legal heir with consent in writing of all the legal heirs, may join the PropTeam.in as Associate Member in place of incapable or the deceased provided he executes written agreement and undertakes to abide by all rules and regulations and terms & conditions etc. in the same manner as that in case of original PropTeam.in. In case of failure to arrival at such consent within six months from the incapability or death of the PropTeam.in, the PropTeam.in shall be at liberty to terminate the unique I.D. and for this period the PropTeam.in will keep his unique ID in abeyance.
12. Associate Member shall be abided by all statutory, central, state and local body laws, rules and regulations and guidelines in operation of PropTeam.in?s business. Associate Member shall not engage in any deceptive of unlawful trade practices as defined under different statutes.
13. Associate Member shall not manipulate the PropTeam.in 's marketing plan, products, rate etc. in any way.
14. Associate Member shall not send, transmit or otherwise communicate any message to anybody on behalf of the PropTeam.in without any authority from the PropTeam.in.
15. Associate Member or any other person under him is strictly prohibited to use promotional material, other than the developed and authorised by the PropTeam.in.
16. Associate Member shall not use the trademark, logotype and design anywhere without written permission of the PropTeam.in and the said permission can be withdrawn at any time by the PropTeam.in.
17. Associate Member shall be self-responsible for all arrangements, expenses and permissions from Central/State Government and local bodies for conducting meetings or seminars.
18. Associate Member shall bear the cost and expenses of conducting its business in accordance with these terms and conditions. The PropTeam.in will not entertain any reimbursement on any expense made by the Associate Member other than reference benefit/ commission earned by the Associate Member as per the marketing plan.
19. Associate Member shall carry his/her Identity Card issued by the PropTeam.in and not visit the consumer premises without prior appointment/approval. He shall not use I.D. Card apart from PropTeam.in purposes.
20. Associate Member shall refer any product for a price declared by PropTeam.in.
21. Associate Member shall not make medical claim for the effects arising out by using the products of the PropTeam.in.
Prohibitions/ Restrictions:
* Associate Member is prohibited from listening, marketing, advertising, promoting, discussing, referring or selling of product or the business opportunity on any website or online forum that offers like auction as a mode of selling.
* Associate Member hereby undertakes not to compel or induce or mislead any person with any false statement or promise to purchase products from the PropTeam.in or to become Associate Member of the PropTeam.in.
Duty and confidentiality:
Associate Member shall keep and maintain secrecy and confidentiality and shall not disclose the secret information to anybody.
Special conditions:
Notwithstanding anything stated or provided herein, the PropTeam.in shall have all powers and discretion to modify, alter or vary the terms and conditions in any manner or mode as the PropTeam.in deems fit and proper and shall be communicated through official website/ App. If any Associate Member does not agree to such modifications/ alterations, he may terminate his agreement within 30 days of such publication by giving a written notice to the PropTeam.in. Without any objection to such modifications/alterations, if Associate Member continues his/her business activities, it will be deemed that he/she has accepted all modifications/alterations for future.
Termination:
PropTeam.in may terminate this agreement on ground of any reason which shall not be limited to the following:
* On non-compliance with the provisions of the marketing plan and discipline of the PropTeam.in.
* For reason of non-performance with the business activities of the PropTeam.in.
* For any unethical or prejudicial work to the interest of the PropTeam.in.
* For breach of any term and condition of this agreement and marketing plan.
* In case information given by Associate Member is found to be misleading/wrong/false.
* If he/she is found to be convicted on any offence punishable under law for the time being in force.
* If he/she is declared bankrupt/insolvent.
* If he/she is not mentally sound or physically fit to handle the business.
* If he/she migrates to other country.
* Where PropTeam.in deems it necessary to terminate the Associate Member in the interest of other Associate Members connected with his/her group/team.
The Associate Member may terminate this agreement at any time by giving written notice to the PropTeam.in.
Termination of a Associate Member means termination of:
* All rights and entitlements as Associate Member of PropTeam.in.
* Personal information given on website/ App
* Identification as Associate Member of PropTeam.in
* Right to go at any PropTeam.in's office and attend PropTeam.in's meetings/seminars.
All the PropTeam.in?s trademarks, trade names, data, photographs, literature, sales aids and all kinds of customer related database and any other information generated shall always remain the property of PropTeam.in. Within five (5) days after the termination of Associate Member, he/she shall return all such items to PropTeam.in. Associate Member shall not make or retain copies of any confidential item or information that may have been entrusted to him/her and upon the termination of Associate Member, he/she shall cease to use all trademarks and trade names of PropTeam.in.
Force Majeure:
The PropTeam.in shall not be liable for any failure to perform its obligations where such failure has resulted due to acts of nature (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, Government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity, any type of redirection by Government (Central/State), Local Authority etc.
Dispute settlement and arbitration:
* If any dispute or difference arises out of or in relation to this agreement including any question regarding its existence, validity, termination or terms and conditions, the PropTeam.in and Associate Member shall endeavour to settle through mutual discussions within 30 days of such dispute arising. In case of dispute or difference is not mutually settled within period, it shall be referred to Grievance Redressal Committee of the PropTeam.in. If Associate Member is not satisfied with the decision of Grievance Redressal Committee and dispute or difference is remaining unsolved, the same shall be referred to sole Arbitrator appointed by the PropTeam.in. The arbitration proceedings shall be conducted at Jaipur in the state of Rajasthan and language shall be English/ Hindi. The decision of Arbitrator will be final and shall have binding effect on the both parties to the agreement.
* The terms and conditions stipulated in the forgoing paragraphs shall be governed in accordance with the law for the time being in force in India. Disputes, either civil or criminal in nature, shall be subject to the exclusive jurisdiction of the court in Jaipur, Rajasthan only.
SMS alerts:
The Associate Member agrees to receive the SMS Alert from the PropTeam.in on Mobile No. mentioned/ quoted and will not object even if they are received despite of DND activated. Associate Member shall intimate the change in Mobile No. (if any).
